10A NCAC 10 .0811. PROVIDER REQUIREMENTS

  • (a)  Each provider shall ensure that the parent or adult legally responsible for the child has unlimited access to his or her child and to the provider during the hours care is provided.

    (b)  No person shall be permitted to participate as a child care provider in the subsidized child care program:

    (1)           who has been convicted of a crime involving child abuse, child neglect, or moral turpitude;

    (2)           who is an habitually excessive user of alcohol;

    (3)           who illegally uses narcotics or other impairing drugs;

    (4)           who is mentally or emotionally impaired to an extent that may be injurious to children;

    (5)           who the Division has disqualified based on the provider's criminal history; or

    (6)           when the Division has disqualified an individual residing in the provider’s home based on the household member's criminal history.

    (c)  The provider shall be at least 18 years of age.
