10A NCAC 26A .0204. CROSS‑REFERENCE TO DEPARTMENTAL RULES

(a) All contested case hearings shall be conducted under the Departmental rules as codified in 10A NCAC 01A .0200.

(b) If the authority for the appeal comes under the authority of the Director, then the proposal for decision shall be submitted to the Director.

(c) If the authority for the appeal comes under the authority of the Commission, then the proposal for decision shall be submitted to the Commission chairman with a copy to the Director.

(d) When the final decision is to be made by the Commission, a quorum of the Commission shall be present and the decision made by a majority of those present.
