As a general practice, the Attorney General does not render an official opinion:
(1) when requested by private citizens not engaged in the business of the state or its instrumentalities or its subdivisions or municipalities;
(2) when the inquiry is directed to the constitutionality of a statute, regulation or rule;
(3) when the subject matter of the inquiry is presently being challenged in litigation or an administrative adjudication.
