13 NCAC 10 .0306. EMPLOYEE CONTEST

(a) An affected employee or authorized employee representative may at any time within 15 working days after the employer posts a citation, file with the issuing director a notice of contest in which objections are made to the period of abatement. Upon receipt of the notice of contest the director shall notify the board thereof. The director shall, within 20 days from his receipt of the notice of contest, file a clear and concise statement of the reasons the period of abatement is not unreasonable.
(b) Not later than 15 days after receipt of the statement referred to in Paragraph (a) of this Rule, the objecting employee or authorized employee representative shall file a response containing a clear and concise statement of the reasons why the abatement period is considered improper. The board shall then afford an opportunity for a hearing.
