13 NCAC 10 .0701. SETTLEMENT

Latest version.

(a) Settlement is encouraged at any stage of the proceedings where such settlement is consistent with the provisions and objectives of the act.

(b) A notice of settlement submitted by the parties shall be accompanied by a clear and concise explanation of the reasons justifying a settlement and the assurance of future compliance. This settlement shall be deemed effective only upon approval of the board or hearing examiner and the issuance of an amended citation.

(c) The settlement agreement and amended citation shall be posted in accordance with the provisions of Rule .0107(e) of this Chapter.
