Upon learning facts sufficient to establish probable cause to believe a violation of Chapter 18B or ABC Commission rules has occurred or is occurring, an agent shall take immediate enforcement action as described in this Section. An agent need not take immediate enforcement action when to do so would jeopardize the safety of individuals or jeopardize the course of an investigation. An agent shall take no enforcement action which he knows or has reason to believe is unlawful or unauthorized.
