14B NCAC 06C .0701. DELIVERING PERMITS

  • (a)  Newly issued permits will be mailed by the ABC Commission directly to the permittee at the mailing address provided by the permittee.  During the application investigation process, the investigating agent shall advise the permit applicant the permit will be mailed to the mailing address which he provides.  The permit applicant shall be advised if the mailing address is incorrect the receipt of the permit will be delayed.  Permits returned to the ABC Commission for improper mailing address will be forwarded to the appropriate district for hand delivery.  These permits shall be delivered by ALE to the permittee no later than the end of business of the following business day.  Any hand delivery of permits will require the completion of the appropriate permit receipt form.

    (b)  Upon delivery or return of a suspended permit, an agent shall obtain the permittee's signature on the permit receipt form.  An agent shall forward one copy of the receipt to the ABC Commission, one to the appropriate local authorities, and retain one for his files.  At the time of delivery, an agent shall clearly explain ABC Commission rules to the permittee or appropriate employee.  An agent shall return suspended permits to the permittee on the morning following the last day of suspension.

    (c)  In the case of the return of a suspended permit, an agent shall examine all alcoholic beverages in an effort to determine whether or not any sales have occurred during the period of suspension.  Appropriate enforcement action should be taken if evidence is developed indicating sales were made during the course of the suspension.
