15A NCAC 01D .0202. REQUEST FROM THE SECRETARY OF THE DEPARTMENT OF ECD

(a)  As the Secretary of the Department of Economic and Community Development (ECD) prepares to make findings pertinent to an application received from a county authority, he will inform the Secretary of EHNR that certain specific findings are being contemplated for a specific project.  At the time of this request, the Secretary of ECD will provide all pertinent project information available to EHNR including all data given to ECD in the application from the county authority.

(b)  If the Secretary of ECD has requested the authority to hold a public hearing on the proposed project, a copy of the public notice of the hearing and a copy of the hearing transcript will be forwarded to the Secretary of EHNR.  Any request on which factual data furnished to EHNR is incomplete or lacking in sufficient detail will be returned to the Secretary of ECD.  Reasons for returning the request will be set out in writing.  Once the additional information is received, EHNR will accept the request as officially received and begin final processing.
