15A NCAC 07J .0402. CRITERIA FOR GRANT OR DENIAL OF PERMIT APPLICATIONS

(a) In making a final decision on a permit appeal, the Commission shall consider only the official record, the written exceptions of the parties, and the oral arguments made before the Commission. The Commission shall grant the permit application unless it can make one or more of the findings in G.S. 113A‑120(a) or (c) which justify a permit denial and the Commission may attach conditions to any permit it issues as provided in G.S. 113A‑120(b).
(b) If the Department denies an application for a permit, the applicant shall be notified by registered mail, return receipt requested, of the action of the Department and the grounds for that action.
