15A NCAC 14B .0102. DEFINITIONS

As used in these Rules:

(1)           "Hearing" shall mean a contested case hearing as provided in G.S. 150B‑23(a).

(2)           "Board" shall mean the Governor's Waste Management Board.

(3)           "Chairman" shall mean the Chairman of the Governor's Waste Management Board.

(4)           "Facility" shall mean any low‑level radioactive waste facility as defined in NCGS 104E‑5(9b) and any hazardous waste facility as defined in NCGS 130A‑290(a)(9).

(5)           "Hearing Panel" shall mean any group of members of the Board appointed by the Chairman and delegated by him the authority to hear an appeal.

(6)           "Hearing Officer" shall mean any person to whom the Chairman delegates authority to hear an appeal.
