20 NCAC 02B .0211. OPTIONAL RETIREMENT PROGRAM

An individual who is employed by a state university at a rank or in a position which does not qualify him for participation in the optional retirement program, as provided by G.S. 135‑5.1, and who later is reclassified to the rank of instructor or above shall be permitted to exercise the option of electing to withdraw from Teachers' and State Employees' Retirement System and to begin participation in the optional retirement program as though he were a new employee.
