25 NCAC 01B .0415. ATTORNEY'S FEES MAY BE AWARDED AS A RESULT OF A SETTLEMENT

  • Attorney's fees may be awarded as the result of a settlement in the grievance procedure, either in the agency internal procedure or at the State Human Resources Commission level, providing such fees are explicitly incorporated as a part of a written settlement agreement signed by both parties.  Attorney's fees shall not be awarded as the result of a settlement unless such fees are a specific part of the written settlement agreement.
