  • If the owner does not agree to sell and the property is vital to the state, the Division of State Property will present a resolution to the Governor and Council of State for approval that authorizes the use of condemnation to acquire the property.  Upon approval of the resolution, the Division of State Property will forward the case to the Office of the Attorney General, which will prepare the necessary papers and file the condemnation.
