01 NCAC 06B .0205. BY LEASE: GENERAL

(a)  When the need for space arises, the requesting department will first contact the Division of State Property to determine whether there is state‑owned or leased space available to fill the need.

(b)  If it is determined that there is no suitable state‑owned or leased space available and the Division of State Property determines that it is in the best interest of the state, the requesting department may then proceed to acquire the needed space in the manner indicated in Regulations .0206 through .0208 of this Section.

(c)  Upon approval of the Governor and Council of State, all leases are forwarded to the Department affected for signature by the lessor.

(d)  All leases must be drawn by or approved as to form by the Office of the Attorney General through the Division of State Property.
