SUBCHAPTER J. PROCEDURES FOR PROCESSING AND ENFORCEMENT OF MAJOR AND MINOR DEVELOPMENT PERMITS, VARIANCE REQUESTS, APPEALS FROM PERMIT DECISIONS, DECLARATORY RULINGS, AND STATIC LINE EXCEPTIONS |
15A NCAC 07J .0401. FINAL DECISION

(a) The Commission shall make a final decision on a permit appeal at a regularly scheduled meeting.
(b) The decision must be made by concurrence of a majority of those present.
(c) The parties shall have 30 days following the date of the recommended decision of the administrative law judge to file written exceptions with the Commission, and the Commission shall not make a final decision concerning an appeal without giving the parties an opportunity to file such exceptions. If all parties consent, the 30‑day period may be shortened or waived.
(d) The Commission shall affirm, modify, or overrule the recommended findings and conclusions of the administrative law judge as provided in G.S. 150B‑36.
