15A NCAC 14B .0109. WHO SHALL CONDUCT A HEARING

  • The Chairman shall determine for each panel whether the appeal should be heard by the full Board, a panel of Board members, or a hearing officer, and shall notify the parties of the determination.  The Chairman is hereby authorized to appoint Board members to a panel or a hearing officer and to delegate to the panel or hearing officer authority to hear an appeal.  The recommended decision made at this stage by the full Board, a panel of the Board members, or a hearing officer shall be presented to the full Board for final decision.
